Terms & Conditions

These General Terms and Conditions apply to all contracts between Skischule Wolfgang Pfeifhofer, Färbergasse 19/1, 5600 St. Johann im Pongau, Austria (hereinafter “ski school”) and its customers (hereinafter “contracting party”). They are based on the General Terms and Conditions of the Salzburg Ski & Snowboard Schools. This translation is provided for convenience; in case of doubt, the German version shall prevail.

1. General

Unless expressly agreed otherwise, these terms apply to all legal transactions and contractual relationships with the ski school. The ski school provides skiing and snowboarding lessons and accompanies its guests in snow sports.

2. Booking, conclusion of contract and prices

Courses can be booked online via our website, in person, by phone or by email.

Our offers are non-binding. The acceptance of a booking and the scope of services are determined solely by the ski school’s written booking confirmation (e.g. by email). Verbal or telephone side agreements are only valid if confirmed in writing by the ski school.

For online bookings, the contract is concluded upon completion of payment and receipt of the booking confirmation by email. For all other bookings, the contract is concluded upon written confirmation or payment on site.

All prices are quoted in euros and, unless agreed otherwise, include statutory VAT. Prices are subject to change; errors and misprints excepted.

3. Payment

For online bookings, the total amount is due at the time of booking via the payment methods offered. For bookings made by email, by phone or in person, the total amount is due before the start of the course, in cash or by common electronic payment methods, unless agreed otherwise.

In the event of late payment, the ski school is entitled to charge statutory default interest.

4. Conditions of participation

At the start of the course, the contracting party must provide the ski school with truthful and complete information about their skiing or snowboarding skills and experience, as well as about their state of health and any conditions that may affect their ability to take part in snow sports or may become acute during the activity.

The contracting party is responsible, at their own expense, for equipment suited to their ability and the conditions, and must have it — in particular the bindings — inspected and adjusted by a specialist shop before the course starts. The ski school is not liable for damage resulting from improper or insufficient inspection, adjustment or maintenance of equipment. Participation may be refused if the equipment is unsafe or defective until the defect has been remedied, without any entitlement to a reduction of the fee for missed lesson time.

Group allocation and level assessment are carried out by the ski school. A necessary move to a lower level must be accepted; otherwise the ski school is entitled to terminate the contract without refunding the fee.

Instructions given by the ski instructors must be followed. Disregarding instructions or warnings, or being under the influence of alcohol or drugs, entitles the ski school to terminate the contract immediately. In these cases there is no entitlement to a refund.

If the number of participants in a group course falls below two, the ski school reserves the right to merge groups or to shorten the lesson time accordingly.

5. Photos

Photos may be taken during lessons and related events and published on our website and social media channels. If you do not want this, please let us know before the course starts.

6. Liability

We strongly recommend taking out health, accident, liability and travel health insurance. In accordance with the statutory provisions, the ski school is only liable for damage connected with its activities that was caused intentionally or through gross negligence. The ski school holds appropriate liability insurance. The ski school is not liable if the contracting party is injured, suffers damage or causes damage by disregarding instructions, the FIS rules of conduct, legal regulations or these terms.

7. Complaints

Complaints must be reported immediately, either directly to the ski instructor or by email to info@skischule-pfeifhofer.com, so that the issue can be resolved quickly. Claims for a reduction of the fee can no longer be considered if the complaint is not raised by the end of the service at the latest. Any other claims must be submitted in writing, with reasons, no later than four weeks after they arise or become known.

8. Cancellation

All courses (private and group courses) can be cancelled free of charge until 5 p.m. on the day before the course starts. After that, the booked rate will be charged. Please cancel by email to info@skischule-pfeifhofer.com or by phone at +43 676 550 32 68.

In the event of illness or accident, we will find an individual solution together (cancellation or rescheduling).

No refund is given for failure to attend the agreed course or for leaving a course in progress. If a course is cancelled due to weather conditions (force majeure), the fee paid will not be refunded.

Lift passes are not included in the course price and must be paid for by the contracting party. The ski school provides no compensation for lesson time lost due to cable car or lift outages.

9. Safety

Under the Salzburg State Sports Act 1988 (LGBl. No. 98/1987), children and adolescents under the age of 15 must wear a ski or snowboard helmet complying with ÖNORM EN 1077:2007 when skiing or snowboarding. All participants must familiarise themselves with and observe the FIS rules of conduct.

10. Place of jurisdiction, place of performance, applicable law

The place of performance is the registered office of the ski school in St. Johann im Pongau. The court having local and subject-matter jurisdiction at the registered office of the ski school shall have jurisdiction over all disputes arising from the contractual relationship. Austrian law applies. Mandatory consumer protection provisions remain unaffected. The contract language is German.

11. Severability

Should individual provisions of these terms be or become invalid, the validity of the remaining provisions and of the contract shall not be affected. The invalid provision shall be replaced by one that comes closest to it in economic terms. Amendments to these terms must be made in writing.
